Affiliate Program Terms & Policies

This is a plain-language summary for operators; the binding agreement is the Atlas by SigmaTools Terms of Service and this policy. Consult your own advisor; this is not legal advice.

The short version

Join the program, share your link, and earn a commission when someone you refer subscribes to Atlas. In exchange, you agree to promote Atlas honestly, disclose that you earn a commission, follow the law, and use our brand only the way we permit. Self-referrals, spam, fake signups, and deceptive claims are not allowed and will cost you your commissions and your spot in the program.

The binding terms are in our Terms of Service Section 15 ("Affiliate & Creator Program"). This page explains and expands those terms in plain English. If anything here ever appears to conflict with Section 15, Section 15 controls. We refer to SigmaTools, LLC and the Atlas product together as "Atlas," "we," or "us," and to you as the "Affiliate" or "you."

1. Your relationship with us (independent contractor)

You participate in the program as an independent contractor. Nothing about the program creates an employment, partnership, joint venture, franchise, or agency relationship between you and Atlas. You are not our employee, and we are not your employer.

You have no authority to bind or speak for Atlas. You may not make any representation, warranty, guarantee, or commitment on our behalf; enter into any agreement in our name; or hold yourself out as an employee, agent, or official spokesperson of Atlas or SigmaTools, LLC. You control how you do your own promotional work, and you are responsible for your own expenses, equipment, and taxes.

2. Eligibility and enrollment

To join and stay in the program you must:

  • Have an Atlas account in good standing, with a confirmed email and completed onboarding, and meet any minimum account-age requirement set in-app (24 hours);
  • Be of the age of majority in your jurisdiction;
  • Provide valid identity, tax, and payout information through our payments partner before any payout is released; and
  • Comply with these terms, the Terms of Service, and all applicable laws.

Enrollment may be automatic or subject to review, and we may decline, pause, or revoke participation at our discretion. When you enroll you receive a referral code (for example ATLAS-XXXXX) and a referral link in the form https://atlas.sigmatools.io/?r=YOURCODE. At the Recruiter tier and above you can also claim a custom vanity link. Always use the link and code we issue to you. Do not try to manufacture, guess, or reroute another person's code.

3. How commissions are earned, approved, and clawed back

Earning. You earn a commission when a person who is attributed to your referral starts a qualifying paid Atlas subscription. Attribution is first-touch and is captured when the referred person first lands with your link, within the attribution window (60 days), and is locked to your account at their sign-up. Exactly one first-conversion commission can ever be earned per referred person.

Commission rate structure. Your commission rate is set per referred subscription and depends on how long that subscription has been paying, measured from that subscription's first payment:

  • Months 1 through 24 (the full-rate window). You earn 30% of the applicable net subscription revenue on each qualifying payment made during the first 24 months after that subscription's first payment. The full-rate window does not depend on your Active status.
  • Month 25 onward (the tail). You earn 10% of the applicable net subscription revenue on each qualifying payment, for as long as that subscription stays active and paid, provided you are in Active status (defined below) when the payment occurs.

Active status (the tail condition). You are in Active status if at least one new referred person made their first qualifying paid subscription payment within the rolling 12 months immediately before the payment being commissioned. If you are not in Active status when a tail-period payment occurs, you earn no commission on that payment, and that commission is never paid retroactively. Tail commissions resume, on payments from that point forward, as soon as you meet the same definition again: at least one new paying referral within the prior rolling 12 months. Active status never affects the 24-month full-rate window.

The current rates, the full-rate duration, the commission basis, the Active-status requirement, the attribution window, hold periods, and minimum payout are shown in-app and may change over time.

Approval and holds. Commissions do not become payable immediately. Each commission is held for a clearing period (30 days for web subscriptions and 60 days for in-app-store subscriptions at launch) to allow for refunds and chargebacks, and your first commission as a brand-new affiliate may be held for an additional probation period (90 days) before it can be paid. A commission flagged for review is not approved until that review clears.

Clawbacks. Commissions accrue only on genuine, completed paid conversions. If a referred payment is later refunded, charged back, or cancelled, or if we determine a commission resulted from fraud, abuse, or a violation of these terms, we will reverse or claw back the affected commission. If the commission was already paid, the clawed-back amount becomes a negative balance that we may offset against your future commissions. Commission balances are tracked as a signed ledger; reversals net against your earnings.

Recurring commissions are not a guarantee. Where we describe commissions as recurring or long-running, we mean for as long as the referred subscription stays active and paid, the rate structure and Active-status conditions above are met, the program continues to operate, and you remain an affiliate in good standing. It is not a promise of perpetual or guaranteed payment, and you must not describe the program as paying "for life" or "lifetime" commissions. See Terms Section 15.

4. Payouts, currency, and taxes

Threshold and schedule. Once your cleared (approved) balance meets the minimum payout amount ($50), you become eligible to be included in a payout run. Payouts are processed in batches on a periodic basis. If your cleared balance is below the minimum, it carries forward until it reaches the threshold.

Method and currency. Payouts are made in US dollars through our third-party payments partner (Stripe Connect). You must complete that partner's onboarding, including identity and tax verification and a valid payout destination, before any payout is released. Payout eligibility is currently limited to supported countries (the United States). The payments partner holds your banking and tax-identification details; we store only the status flags we need to run payouts.

Taxes are your responsibility. You are solely responsible for determining, reporting, and paying any taxes on the commissions you earn. We do not withhold taxes for you. If you are a US person, you must provide a valid Form W-9, and where your payments meet or exceed the IRS reporting threshold for a calendar year (we track a configurable threshold, $2,000), we or our payments partner may issue a Form 1099-NEC (or other applicable form) as required by law. Non-US affiliates may be asked for the equivalent tax documentation. Providing accurate tax information is a condition of payout.

No payment for self-referrals. You earn no commission on your own subscription or on a referral of yourself, and purchases made through your own link do not qualify. Self-referral commissions are automatically voided.

5. FTC compliance: required disclosures (this is mandatory)

Because you earn a commission, you have a material connection to Atlas that your audience would not expect. US law requires you to disclose it. You must clearly and conspicuously disclose your affiliate relationship on every post, video, story, email, stream, or other endorsement that promotes Atlas or includes your referral link, in compliance with the FTC Endorsement Guides (16 CFR Part 255).

  • Make the disclosure hard to miss: place it up front and in the same place as the endorsement, not buried in a comment, a link description, a hashtag pile, or behind a "more" cutoff. Match the format to the medium (on-screen and spoken for video, in the caption for images, in the body for text).
  • Use plain, unambiguous language such as "#ad," "advertisement," "paid partnership," or "I earn a commission if you sign up with my link." A bare "#sp," "#ambassador," or affiliate-link icon is not sufficient on its own.
  • Only endorse Atlas if you actually use it, and only make claims you honestly believe and can back up. No deceptive, misleading, or unsubstantiated claims. Do not fabricate results, reviews, or testimonials, and do not misrepresent the price, the offer, what is free versus paid, or what Atlas does.

Health and fitness claims. Atlas is a fitness-tracking tool, not a medical device, and you must not present it as one or give medical advice. Any health, fitness, body, or results claims you make must be truthful, typical, and substantiated, and must not promise specific health outcomes. Mirror our Health & Fitness Disclaimer and make clear that Atlas is informational and not a substitute for a qualified healthcare professional.

6. Prohibited conduct

The following are prohibited. Engaging in any of them lets us withhold, reduce, reverse, or claw back commissions and suspend, fraud-flag, or permanently remove you from the program, in our discretion. On a ban, all of your not-yet-paid commissions are voided.

  • Spam and unsolicited messaging. No unsolicited bulk email, SMS, DMs, or comment spam. If you email, you must comply with the CAN-SPAM Act and similar laws (honest subject lines and sender info, a valid physical address, and a working unsubscribe), and with the platform rules wherever you post.
  • Trademark bidding and brand keyword paid search. Do not bid on, or buy paid search or social ads targeting, "Atlas," "Atlas by SigmaTools," "SigmaTools," our other marks, or confusingly similar terms or misspellings, and do not use them in ad copy, display URLs, or as a domain. Do not run ads that appear to be official Atlas ads.
  • Cookie stuffing and forced clicks. No dropping referral cookies or firing your link without a genuine, intentional user click, and no pop-unders, hidden iframes, auto-redirects, or similar tricks.
  • Fake accounts and self-dealing. No fake, incentivized, or bot signups; no creating accounts to refer yourself; and no buying through your own link or arranging others to funnel their own purchases back to you.
  • Impersonation. Do not impersonate Atlas or SigmaTools, pose as our employee or official account, operate look-alike sites or social accounts, or otherwise imply you are us or speak for us.
  • Misrepresenting price or offer. Do not advertise prices, discounts, trials, coupons, or terms we are not actually offering, and do not create fake urgency or fake endorsements.
  • Unlawful or off-brand placement. Do not promote Atlas on sites or in content that is illegal, infringing, hateful, harassing, sexually explicit, or otherwise objectionable, consistent with the zero-tolerance standard in our Terms.

7. Brand and intellectual-property license

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Atlas name, logo, and approved marketing assets solely to promote Atlas through the program, and only as described in our Brand Kit and any guidelines we provide.

  • Always present us as "Atlas by SigmaTools." Atlas is a widely used name, so on first or prominent reference make clear you mean our product by using "Atlas by SigmaTools" rather than just "Atlas," to avoid confusion with other products.
  • No modification of the marks. Do not alter, recolor, distort, animate, or recreate our logo or marks; do not combine them with your own logo into a single mark; and do not use them in a way that implies sponsorship, endorsement, or partnership beyond your role as an affiliate.
  • Use only current, approved assets from the Brand Kit. We may update the assets and guidelines, and you agree to use the latest versions.

Reservation of rights. All rights in the Atlas and SigmaTools names, logos, marks, and other intellectual property remain ours (or our licensors'). This license grants you no ownership and no rights beyond what is expressly stated, and it ends automatically when your participation ends or when we revoke it. All goodwill from your use of the marks inures to us.

8. Privacy and data you collect

If you collect any personal information in connection with your promotion of Atlas (for example, email addresses for a list), you are responsible for handling it lawfully. You must comply with all applicable privacy and marketing laws, maintain your own privacy notice where required, obtain any necessary consents, and honor opt-outs. Do not represent that you collect data on our behalf, and do not share another person's personal information with us except as we request. Our handling of data is described in our Privacy Policy.

9. Term, termination, and survival

The program is at-will. Either you or we may end your participation at any time, for any reason, with or without notice. We may also suspend, fraud-flag, or terminate participation immediately for any actual or suspected fraud, abuse, or violation of these terms or the Terms of Service.

Effect on pending commissions. If you leave or are terminated without cause, commissions that have already cleared and become payable remain payable subject to the normal payout rules and minimum threshold; uncleared commissions may be forfeited. If you are terminated or banned for cause (fraud, abuse, or unlawful conduct), all of your not-yet-paid commissions may be voided and forfeited, and we may withhold or reverse paid amounts tied to the violation. Your brand license ends immediately on termination, and you must stop using our marks and referral links and remove claims that you are an active affiliate.

Survival. The sections on clawbacks, taxes, intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

10. Disclaimers, limitation of liability, and indemnification

THE PROGRAM AND ALL RELATED MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee any minimum earnings, number of referrals, conversion rate, tracking accuracy, or program availability, and any examples of earnings are illustrative, not promises.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR EXPECTED COMMISSIONS, ARISING OUT OF OR RELATING TO THE PROGRAM. Our total liability relating to the program is limited as set out in the Terms of Service, and in any case will not exceed the total commissions actually paid to you in the twelve (12) months before the event giving rise to the claim.

Indemnification. You agree to defend, indemnify, and hold harmless Atlas and SigmaTools, LLC and their affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to your participation in the program, your promotional content and methods, your disclosures (or failure to disclose), your use of our marks, your collection or use of any data, or your violation of these terms, the Terms of Service, any third-party right, or any law.

11. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, and are subject to the dispute-resolution, arbitration, and venue provisions of the Terms of Service. Where those provisions do not apply, the parties consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.

12. Changes to the program and these terms

We may modify, suspend, or end the program, any commission rate (including the tail rate), the full-rate duration, the Active-status requirement, the attribution window, hold periods, payout thresholds, tiers, or any other program term, in whole or in part, at any time and for any reason, with or without notice. Changes apply going forward. The live values in the app and in our Terms of Service control over any number stated here. We will update the "Last updated" date above when we change this page, and your continued participation after a change takes effect is acceptance of it.
